ORGAN TRAFFICKING

THE BODY BAZAAR

In the dark alleys of the medical world, humans are reduced to spare parts. Organ Trafficking is the commodification of life itself—where a kidney is sold to pay a debt, and a liver is stolen for greed.

It exploits the desperation of the poor to extend the lives of the rich. Under the guise of "voluntary donation," a brutal industry operates with surgical precision.

The "Kidney Belt" Reality

In impoverished belts of India, entire villages bear the scar of the nephrectomy. Agents prowl these areas, offering "easy money" for a kidney. What they don't mention is the lifetime of health complications and the meager pay that vanishes in months.

Modes of Trafficking

  • The Fake Relative: Forging documents to prove the donor is related to the recipient (required by law).
  • The "Check-up": Victims are lured for a "minor surgery" or "medical test" and wake up with an organ missing.
  • Debt Bondage: Lenders force borrowers to sell an organ to settle high-interest loans.

The Donor's Aftermath

Post-Op InfectionHigh Risk

Illegal surgeries lack sterility, leading to sepsis.

Physical CapacityReduced

Donors can no longer perform heavy labor.

Social StigmaSevere

Often ostracized by community for "selling their body."

"The scar is not just on their abdomen; it marks the point where their dignity was harvested."

Part 3: The Law

Transplantation of Human Organs Act (THOA) 1994

The primary legislation regulating transplants and banning commercial trade.

Section 19 (THOA)

Commercial Dealings

"Punishment for commercial dealings in human organs... buying, selling, or negotiating." The backbone of the ban.

5-10 Years Jail + ₹20L Fine

BNS Section 143

Trafficking of Persons

"Exploitation shall include... physical exploitation... or the removal of organs." This links organ trade to human trafficking.

10 Years to Life Imprisonment

Key Regulations

Only Near Relatives

Donors must be "near relatives" (Parents, Spouse, Siblings, Children). Distant relatives require special government approval.

Authorization Committee

Every hospital must have a committee to interview donors and ensure no money is exchanged. (This is where forgery often happens).

Doctor Liability

Doctors found guilty of conducting illegal transplants can be struck off the Medical Register permanently.

Part 4: The Barriers

Why Does It Persist?

Demand Supply Gap

India needs 2 Lakh kidneys annually but gets only 6,000. This massive shortage drives wealthy patients to the black market.

Forgery

Brokers create high-quality fake Aadhar cards and marriage certificates to prove a "relationship" between donor and recipient.

Medical Complicity

The crime requires highly skilled surgeons and hospitals. It cannot happen in a back alley; it happens in OTs.

Poverty

For a person in crushing debt, selling a kidney seems like the only way out. Brokers exploit this vulnerability.

Transplant Tourism

Foreign nationals come to India for cheaper "no-questions-asked" transplants, fueling the international trade.

YOUR ROLE

Register as a legal organ donor (Deceased Donation). One body can save 8 lives, reducing the need for illegal trade.

Part 5: The Response

BRAC INTEGRITY PROTOCOL

Fighting the trade through verification, law, and awareness.

1. Whistleblower Network

Eyes inside the system.

• Hospital Staff: Encouraging nurses/techs to report suspicious cases.
• Document Verification: Helping hospitals spot fake donor IDs.
• Anonymous Hotline: Safe channel for reporting illegal brokers.

2. Legal Intervention

Prosecuting the network.

• PILs: Filing Public Interest Litigations for stricter audits.
• Victim Defense: Representing coerced donors (treating them as victims, not criminals).

3. Post-Op Care

Saving the donor's health.

• Medical Checkups: Free renal function tests for exploited donors.
• Medication: Providing antibiotics to prevent post-surgery sepsis.

4. Promoting Deceased Donation

The long-term solution.

• Awareness: Dispelling myths about organ donation.
• Pledging Drives: Encouraging citizens to sign donor cards.

5. Economic Rehabilitation

Removing the financial desperation.

• Debt Relief: Legal counseling to handle loan sharks.
• Skill Dev: Training donors for less physically demanding jobs.

Frequently Asked Questions

Is selling a kidney legal in India?

No. The Transplantation of Human Organs Act (THOA) 1994 strictly bans any commercial dealing in organs. Both the buyer and seller can be jailed.

Can I donate an organ to a friend?

Yes, but only out of "Love and Affection" without any monetary exchange. This requires strict approval from the State Authorization Committee to prove no money is involved.

What is Deceased Donation?

It is donating organs (heart, liver, kidneys) after brain death. One deceased donor can save up to 8 lives. BRAC encourages pledging your organs.

Is my donation tax deductible?

Yes. BRAC is registered under Section 80G. You will receive a tax exemption certificate via email within 7 days.
