For centuries, the law criminalized love that dared to speak its name. Sexuality Minorities (Lesbian, Gay, Bisexual, Pansexual, Asexual) have fought a long battle to prove that their existence is not a crime, but a variation of human nature.

While the decriminalization of Section 377 was a historic victory, the journey towards full civil rights—marriage, adoption, and succession—is the new frontier of the movement.

Orientation vs. Identity

Sexual orientation (who you love) is distinct from Gender Identity (who you are). While the Transgender Act protects gender identity, there is no specific central law protecting people based on Sexual Orientation against discrimination in the private sector.

The Civil Rights Gap

  • Marriage: Same-sex couples cannot legally marry, denying them rights to joint insurance, gratuity, and spousal visas.
  • Adoption: CARA guidelines prohibit unmarried couples from adopting together, effectively barring gay couples.
  • Conversion Therapy: The practice of trying to "cure" sexuality through medication or shock therapy is rampant, despite NMC bans.

Decriminalization

The Supreme Court struck down Section 377 IPC to the extent it criminalized consensual same-sex acts. It affirmed that sexuality is intrinsic to privacy and dignity.

Why Is Freedom Restricted?

No Legal Recognition

Same-sex partners are legal strangers. They cannot inherit property without a will, nor can they make medical decisions for an unconscious partner.

Rental Bias

"Bachelors Allowed, Families Allowed, No Singles/Partners." Housing discrimination forces many couples to hide their relationship.

Police Harassment

Despite 377 being gone, police often use "public nuisance" laws to harass couples in parks or public spaces.

Family Pressure

"Corrective Rape" and forced heterosexual marriages are still used by families to "cure" their children.

Workplace Closet

Fear of being "outed" and losing promotion opportunities keeps many invisible in the corporate world.

Frequently Asked Questions

Can same-sex couples open joint accounts?

Yes. The Reserve Bank of India (RBI) in 2024 clarified that same-sex partners can open joint bank accounts and nominate each other, regardless of marital status.

Is conversion therapy illegal?

Yes. The National Medical Commission (NMC) has declared it "professional misconduct." Any doctor practicing it can face disciplinary action.
