The "Anti-National" Label

The easiest way to discredit a defender is to brand them an enemy of the state. By labeling environmental lawyers as "development blockers" or human rights journalists as "terror sympathizers," the state justifies their surveillance and arrest.

Methods of Suppression

  • Process as Punishment: Filing multiple false FIRs across different states, forcing the activist to spend all their money and time in courts.
  • Digital Surveillance: Using spyware (like Pegasus) to track movements, chats, and sources of journalists and lawyers.
  • Financial Choking: Canceling FCRA licenses of NGOs to cut off funding for legal aid and fieldwork.

Unlawful Activities (Prevention) Act. Allows the state to designate individuals as terrorists and jail them for years without bail or trial.

BNS Section 152 (Sedition Redefined)

Replaces IPC 124A (Sedition). Punishes acts "endangering sovereignty, unity and integrity of India." Critics fear it is vague and prone to misuse against activists.

Right to Legal Aid (Art 39A)

The state must ensure that no citizen is denied justice due to economic reasons. BRAC steps in here.

Indefinite Jail
