TERMS &
CONDITIONS

Rules governing access to, participation in, and use of BRAC platforms, services, campaigns, community initiatives, programs, and digital resources.

INTRODUCTION

Welcome to BRAC Global Social Foundation ("BRAC", "we", "our", "us", "the Organization", or "the Platform").

These Terms & Conditions govern access to and use of donatebrac.org, brac.in, associated subdomains, campaign pages, fundraising systems, crowdfunding services, donation portals, grant application systems, petition platforms, volunteer programs, internship initiatives, awareness campaigns, reporting systems, community services, directories, educational resources, digital tools, and related services operated or authorized by BRAC Global Social Foundation.

By accessing, browsing, registering, donating, participating, submitting content, creating campaigns, applying for grants, signing petitions, using tools, reporting incidents, volunteering, or otherwise interacting with the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions.

If you do not agree with these Terms & Conditions, you should discontinue use of the Platform immediately.

ELIGIBILITY & ACCEPTANCE

Users must be at least eighteen (18) years of age or have the permission and supervision of a parent, legal guardian, educational institution, or authorized representative where applicable.

By using the Platform, you represent and warrant that:

You possess the legal capacity to accept these Terms & Conditions.
Information submitted by you is accurate, truthful, complete, and current.
Your use of the Platform complies with applicable laws and regulations.
You will not use the Platform for unlawful, fraudulent, harmful, misleading, abusive, or prohibited purposes.

Continued use of the Platform constitutes ongoing acceptance of these Terms & Conditions and any future amendments.

USER ACCOUNTS

Certain Platform features may require users to register or create an account.

Users may participate as:

Donors
Fundraisers
Campaign Creators
Volunteers
Interns
Petition Supporters
Grant Applicants
Community Members
Beneficiaries
Authorized Representatives

Users are responsible for:

Maintaining the confidentiality of login credentials.
Restricting unauthorized access to their account.
Providing accurate and updated information.
Ensuring compliance with applicable laws and Platform policies.
Promptly reporting unauthorized access or suspected security incidents.

BRAC reserves the right to verify identities, request additional information, suspend accounts, restrict access, remove privileges, or terminate accounts where fraud, abuse, misrepresentation, policy violations, security concerns, or unlawful activity are suspected.

Users remain responsible for activities performed through their accounts unless unauthorized access has been reported through official channels.

USER CONDUCT

Users agree to use the Platform responsibly, ethically, lawfully, and in a manner consistent with the Organization's mission and community standards.

Users shall not:

Submit false, misleading, deceptive, or fraudulent information.
Upload unlawful, abusive, defamatory, threatening, discriminatory, hateful, obscene, or harmful content.
Impersonate another person, institution, government authority, or organization.
Attempt unauthorized access to systems, accounts, databases, or infrastructure.
Distribute malware, viruses, spam, phishing content, automated attacks, or harmful code.
Misuse fundraising, grant, petition, reporting, volunteer, internship, SOS, or community features.
Violate intellectual property rights.
Interfere with Platform operations or security controls.

BRAC reserves the right to investigate violations and take appropriate action, including content removal, account suspension, legal action, reporting to authorities, or permanent restrictions.

DONATIONS, FUNDRAISING & CROWDFUNDING

The Platform may facilitate charitable donations, crowdfunding campaigns, fundraising initiatives, emergency appeals, social impact projects, community support activities, and related charitable programs.

By making a contribution, donors acknowledge that:

Donations are voluntary.
Donations are generally non-refundable unless otherwise required by law or expressly approved by BRAC under applicable policies.
Campaign information may depend upon submissions provided by beneficiaries, campaign creators, organizations, institutions, or other participants.
Contributions may support charitable programs, beneficiary assistance, operational requirements, technology infrastructure, compliance obligations, fraud prevention systems, transparency initiatives, audit functions, administrative activities, or other lawful charitable purposes.
Tax benefits, where applicable, remain subject to prevailing laws, regulatory requirements, verification procedures, and eligibility conditions.

BRAC reserves the right to review, verify, suspend, reject, investigate, redirect, withhold, refund, or remove fundraising activities where concerns relating to fraud, misrepresentation, compliance, legality, safety, or platform integrity arise.

Nothing contained on the Platform shall be interpreted as investment advice, financial advice, guaranteed returns, profit-sharing opportunities, or promises of specific outcomes.

CAMPAIGN CREATOR RESPONSIBILITIES

Individuals, groups, organizations, institutions, beneficiaries, volunteers, or entities creating campaigns on the Platform remain solely responsible for the accuracy, legality, authenticity, and completeness of information provided.

Campaign creators agree to:

Provide truthful and verifiable information.
Submit documentation when requested.
Use funds solely for lawful and disclosed purposes.
Cooperate with verification, compliance, audit, and review procedures.
Provide updates where required by campaign policies.
Refrain from misleading statements, fabricated claims, forged documentation, or deceptive fundraising practices.

BRAC may request additional information, delay withdrawals, suspend campaigns, restrict access, conduct investigations, remove content, or terminate campaigns where concerns regarding authenticity, legality, transparency, beneficiary protection, safety, or compliance arise.

Campaign creators remain legally responsible for all information submitted through their campaigns and for any consequences arising from misrepresentation, misuse of funds, fraud, or violations of applicable laws.

REFUNDS, CANCELLATIONS & PAYMENT REVERSALS

BRAC processes donations, charitable contributions, crowdfunding support, grant-related contributions, campaign donations, and other voluntary payments through authorized payment channels.

Users acknowledge that:

Donations are voluntary.
Donations are generally non-refundable.
Contributions are intended to support charitable, social impact, community, advocacy, welfare, educational, humanitarian, operational, or related organizational purposes.

Refund requests may be considered only in limited circumstances including:

Duplicate transactions
Technical processing errors
Unauthorized transactions verified through appropriate review procedures
Incorrect payment amounts resulting from technical malfunction
Other exceptional circumstances approved by BRAC

Refund approval remains subject to verification, investigation, compliance requirements, payment processor policies, fraud-prevention reviews, legal obligations, and organizational discretion.

Approved refunds may be processed through the original payment method or any other lawful method determined appropriate by BRAC.

BRAC reserves the right to deny refund requests where:

Donations were voluntarily made.
Funds have already been allocated, transferred, utilized, committed, or disbursed.
Fraudulent refund claims are suspected.
Applicable laws, regulations, payment-provider rules, or operational requirements prevent reversal.

Campaign cancellation, suspension, closure, rejection, removal, completion, expiration, or modification does not automatically entitle donors, contributors, campaign creators, applicants, or participants to refunds.

Payment gateway charges, banking fees, transaction processing costs, foreign exchange charges, regulatory deductions, or other third-party costs may be non-refundable where applicable.

Users should carefully review contribution details before completing any transaction.

BRAC FOREVER FUND

The BRAC Forever Fund is a long-term supporter recognition and social impact initiative established to acknowledge individuals, organizations, institutions, philanthropists, and community members who contribute toward sustainable charitable and public-benefit objectives.

Participation in the BRAC Forever Fund may include recognition programs, supporter listings, digital acknowledgments, certificates, badges, donor walls, legacy records, appreciation programs, and related honorary initiatives.

Users acknowledge that participation in the BRAC Forever Fund does not create:

Ownership rights
Equity interests
Governance authority
Voting rights
Partnership status
Investment interests
Profit-sharing rights
Financial returns
Contractual entitlements

Recognition programs remain honorary and symbolic in nature.

BRAC reserves the right to modify, update, restructure, suspend, merge, discontinue, or replace any recognition program, donor category, supporter tier, listing, badge, certificate, acknowledgment system, or related feature where necessary for operational, legal, technical, compliance, security, privacy, or organizational reasons.

Recognition remains subject to verification, platform policies, applicable laws, and administrative review.

PETITIONS & ADVOCACY SERVICES

The Platform may provide petition systems, awareness campaigns, advocacy initiatives, public-interest programs, civic participation opportunities, social impact movements, and community engagement activities.

Users acknowledge that petitions, endorsements, signatures, support counts, comments, campaign participation, and public engagement indicators represent expressions of public participation only.

BRAC does not guarantee:

Government action
Policy changes
Legislative amendments
Administrative decisions
Regulatory intervention
Court orders
Official investigations
Third-party compliance
Public authority responses

Petitions and advocacy campaigns are intended solely to encourage lawful civic participation, awareness-building, public engagement, and constructive social dialogue.

Users remain solely responsible for content submitted through petitions, campaign updates, comments, or related participation activities.

BRAC reserves the right to review, moderate, suspend, restrict, remove, archive, reject, or discontinue petitions where concerns relating to legality, safety, misinformation, fraud, abuse, privacy, public interest, compliance, or policy violations arise.

9. VOLUNTEER & MEMBERSHIP PARTICIPATION

The Platform may provide opportunities for volunteer participation, membership programs, school and college community-service programs, ambassador initiatives, leadership opportunities, educational engagement programs, social impact projects, and related community activities.

Participation in such programs does not create:

Employment relationships
Agency relationships
Partnership arrangements
Joint ventures
Guaranteed future opportunities
Financial entitlements
Contractual employment rights

unless expressly agreed in writing by BRAC.

Participants are expected to:

Act professionally and respectfully.
Follow organizational policies and community standards.
Comply with applicable laws and regulations.
Represent the Organization responsibly where authorized.
Protect confidential information.

BRAC reserves the right to review, approve, reject, suspend, limit, revoke, or terminate participation in any volunteer, ambassador, membership, leadership, or community program at its discretion.

Any misconduct, misrepresentation, policy violation, abuse of authority, unlawful conduct, harassment, or misuse of organizational resources may result in immediate removal from participation.

SOS EMERGENCY ASSISTANCE SERVICES

The Platform may provide SOS features, emergency request tools, support channels, communication mechanisms, awareness systems, location-sharing capabilities, referral pathways, or related assistance services intended to facilitate emergency communication and support requests.

Users acknowledge that BRAC is not:

A police authority
A law enforcement agency
A hospital
An ambulance provider
A fire service
A disaster management authority
A rescue agency
A medical institution
A government emergency response service

Use of SOS services does not guarantee:

Immediate assistance
Emergency response
Medical treatment
Rescue operations
Law enforcement intervention
Communication delivery
Successful outcomes
Resolution of emergencies

Users experiencing emergencies should immediately contact appropriate emergency services, police authorities, hospitals, healthcare providers, disaster management agencies, or other competent authorities.

BRAC shall not be liable for delays, interruptions, communication failures, response failures, technical issues, service unavailability, or outcomes arising from the use of SOS services.

REPORT BRAC SYSTEM

The Platform may permit users to submit complaints, grievances, concerns, observations, allegations, whistleblower disclosures, public-interest reports, corruption reports, safety concerns, anti-drug reports, senior citizen concerns, and related submissions through the Report BRAC system.

Users acknowledge that:

Submitted information constitutes user-generated content.
Submission of a report does not establish wrongdoing, misconduct, criminal liability, regulatory violations, or factual accuracy.
Individuals, institutions, and organizations referenced in reports remain presumed innocent unless determined otherwise by a competent authority.

Users shall not knowingly submit:

False information
Fabricated allegations
Fraudulent evidence
Defamatory content
Malicious reports
Harassing submissions
Unlawful material
Misleading claims

BRAC reserves the right to review, verify, investigate, reject, remove, archive, restrict, moderate, forward, report, or otherwise process submissions where appropriate under applicable laws, safety considerations, platform policies, compliance obligations, or organizational procedures.

Submission of a report does not create an obligation upon BRAC to investigate, publish, act upon, resolve, or pursue any particular outcome.

The Organization may cooperate with lawful authorities where legally required or where public safety, legal obligations, fraud prevention, or public-interest considerations reasonably justify such cooperation.

INDIA SERVICES DIRECTORY

The Platform may provide directories, listings, public resources, government references, institutional information, service links, contact details, public-benefit resources, and informational databases for public convenience.

The India Services Directory is intended to assist users in discovering and accessing publicly available information relating to government departments, public authorities, welfare programs, educational institutions, healthcare services, regulatory agencies, emergency contacts, and other community resources.

Users acknowledge that:

Information may originate from third-party sources.
Government departments and service providers may modify information without notice.
Availability, eligibility, requirements, procedures, and services may change over time.

BRAC does not own, operate, manage, control, supervise, endorse, or guarantee any government department, institution, authority, agency, scheme, service provider, organization, or third-party website referenced within the directory.

Users remain solely responsible for independently verifying information before relying upon it for legal, financial, educational, healthcare, employment, regulatory, administrative, or other important purposes.

BRAC shall not be liable for actions, omissions, inaccuracies, interruptions, delays, decisions, outcomes, or consequences arising from the use of directory information or third-party resources.

FREE TOOLS & DIGITAL RESOURCES

The Platform may provide calculators, generators, converters, document utilities, productivity tools, educational tools, informational resources, software utilities, digital services, and related public-use technologies for convenience and informational purposes.

Such tools are provided on an "AS IS" and "AS AVAILABLE" basis.

BRAC does not warrant that:

Results will always be accurate.
Outputs will be error-free.
Services will be uninterrupted.
Data will always be preserved.
Generated content will be suitable for a particular purpose.
Tools will remain permanently available.

Users are solely responsible for reviewing, validating, and verifying any outputs, calculations, generated documents, files, or information produced through the use of Platform tools.

The Organization shall not be responsible for losses, damages, errors, omissions, inaccuracies, decisions, or consequences resulting from reliance upon tool-generated outputs or related digital resources.

GRANT APPLICATIONS & ASSISTANCE PROGRAMS

The Platform may facilitate grant applications, educational assistance requests, medical support applications, emergency aid requests, welfare support requests, community benefit initiatives, BRAC Forever Fund assistance programs, and other charitable support mechanisms.

Submission of an application does not guarantee:

Approval
Funding
Financial assistance
Grant allocation
Eligibility confirmation
Continued support
Future assistance

All applications remain subject to:

Eligibility assessments
Verification procedures
Documentation review
Compliance requirements
Fraud prevention measures
Availability of resources
Internal evaluation processes

Applicants agree that:

Information submitted must be truthful, complete, and accurate.
Supporting documents may be requested at any stage.
Additional verification may be conducted where necessary.
BRAC may contact institutions, references, healthcare providers, educational institutions, government authorities, or other relevant parties where lawful and reasonably necessary.

BRAC reserves the right to approve, reject, defer, suspend, investigate, modify, discontinue, withdraw, or close any application without creating an obligation to provide assistance.

Grant decisions remain final unless otherwise required by applicable law.

The Organization shall not be liable for losses, expenses, expectations, opportunities, delays, or consequences arising from application outcomes, eligibility determinations, funding limitations, verification procedures, or grant decisions.

LOST & FOUND NATIONAL RECOVERY GRID

The Platform may provide Lost & Found Services, Missing Person Reporting Systems, Recovery Assistance Programs, Public Recovery Directories, Found Property Registries, Intelligence Submission Channels, Missing Document Services, Missing Animal Reporting Services, and related community recovery features.

Users acknowledge that:

BRAC operates as a facilitation, moderation, and verification platform.
Submission of a report does not guarantee recovery, identification, return, or successful resolution.
All submissions may be subject to administrative review before publication.
BRAC may approve, reject, restrict, modify, archive, suspend, investigate, remove, or decline publication of any submission where concerns regarding authenticity, privacy, safety, legality, fraud prevention, public interest, or policy compliance arise.

To protect privacy and reduce fraudulent claims:

Personal contact information may remain hidden.
Ownership verification may be required.
Claimants may be required to provide proof of ownership.
BRAC may request photographs, purchase records, serial numbers, IMEI numbers, identification documents, police reports, passwords, unique identifiers, witness information, or other reasonable evidence.

The Organization may facilitate communication and verification procedures between parties where appropriate. However, direct communication between users may be restricted, delayed, moderated, withheld, or denied where necessary to protect privacy, safety, security, compliance obligations, fraud prevention interests, or investigative processes.

Users shall not submit:

False claims
Fraudulent ownership requests
Fabricated evidence
Misleading reports
Defamatory information
Unlawful content
Stolen property claims

BRAC reserves the right to reject claims, suspend participation, remove suspicious listings, cooperate with lawful authorities, or take appropriate action where misuse is identified.

BRAC does not guarantee:

Recovery of lost property
Return of missing items
Successful ownership verification
Identification of missing persons
Accuracy of user-submitted information
Recovery timelines
Actions by third parties

Use of the National Recovery Grid remains voluntary and undertaken at the user's own risk.

INTERNSHIP PROGRAMS & EDUCATIONAL PARTICIPATION

The Platform may provide internship programs, student engagement initiatives, educational participation opportunities, community service programs, social impact projects, volunteer-learning experiences, institutional partnerships, and related academic or skill-development activities.

Such programs may be available to:

School students
College students
University students
Researchers
Graduates
Educational institutions
Community participants
Other eligible individuals

Participation in internship or educational programs is voluntary and subject to eligibility requirements, organizational policies, verification procedures, conduct standards, attendance requirements, project completion requirements, and applicable program guidelines.

BRAC may, at its sole discretion, provide:

Internship certificates
Participation certificates
Community service records
Project acknowledgments
Recommendation letters
Appreciation certificates
Educational recognition documents
Related program-based recognitions

Issuance of any certificate, recommendation, acknowledgment, or recognition remains subject to successful completion of applicable requirements and compliance with organizational standards.

Participation in an internship or educational program does not guarantee:

Employment opportunities
Future placement
Permanent association
Academic credit recognition
Scholarships
Financial assistance
Paid positions
Future selection into other programs

Participants are expected to act professionally, ethically, respectfully, and in compliance with applicable laws, institutional requirements, Platform policies, and organizational standards.

BRAC reserves the right to approve, reject, suspend, restrict, revoke, terminate, or otherwise modify participation in any internship, educational, training, leadership, or community engagement program where necessary for operational, legal, disciplinary, compliance, safety, reputational, or organizational reasons.

The Organization shall not be liable for academic decisions, institutional determinations, credit recognition outcomes, employment opportunities, career outcomes, or third-party decisions relating to participation in internship or educational programs.

EDUCATIONAL CONTENT & KNOW YOUR RIGHTS

The Platform may publish articles, awareness campaigns, educational materials, public-interest resources, research summaries, legal awareness content, community education materials, Know Your Rights publications, informational guides, and related content.

Such content is provided solely for educational, informational, awareness-building, and public-interest purposes.

Nothing published through the Platform constitutes:

Legal advice
Financial advice
Tax advice
Medical advice
Professional consultation
Regulatory guidance
Government-approved advice

Users should seek guidance from appropriately qualified professionals before making legal, financial, tax, healthcare, regulatory, or other significant decisions.

BRAC does not guarantee the completeness, accuracy, applicability, suitability, or continued availability of informational content.

The Organization shall not be responsible for actions, interpretations, decisions, outcomes, losses, damages, or consequences arising from reliance upon educational materials, awareness content, or informational resources published through the Platform.

THIRD-PARTY SERVICES & EXTERNAL LINKS

The Platform may contain links, integrations, references, APIs, payment gateways, cloud infrastructure services, communication platforms, verification systems, analytics services, embedded content, advertisements, software tools, social media integrations, external resources, and other third-party technologies.

Such third-party services operate independently and are governed by their own terms, privacy policies, operational practices, and legal requirements.

BRAC does not control and shall not be responsible for:

Third-party content
External websites
Payment gateway operations
Service interruptions
Security incidents
Data processing practices
Privacy practices
Technical failures
Service availability
Actions or omissions of third parties

Users access third-party services entirely at their own discretion and risk.

The inclusion of any third-party service, link, integration, reference, or resource shall not be interpreted as an endorsement, guarantee, sponsorship, recommendation, or approval by BRAC unless expressly stated otherwise.

INTELLECTUAL PROPERTY RIGHTS

All content, materials, software, graphics, visual designs, layouts, databases, branding elements, trademarks, logos, educational resources, directories, campaign content, publications, source code components, interfaces, documents, reports, systems, and proprietary materials made available through the Platform are protected by applicable intellectual property laws.

This includes, without limitation:

BRAC®
Bureau of Randomly Active Committee®
Logos and branding assets
Platform architecture
Website designs
User interface and user experience elements
BRAC Forever Fund systems
Grant management systems
Recovery Grid systems
Educational publications
Articles and awareness resources
Databases and directories
Proprietary software components

No material may be copied, reproduced, modified, distributed, republished, reverse engineered, licensed, sold, exploited, or otherwise used without prior written authorization from BRAC or the applicable rights holder.

Unauthorized use may result in suspension of access, legal proceedings, civil remedies, criminal action where applicable, and enforcement of intellectual property rights.

PRIVACY & DATA PROTECTION

BRAC respects the privacy of donors, applicants, volunteers, interns, campaign creators, beneficiaries, petition participants, supporters, members, and visitors.

The collection, processing, storage, retention, disclosure, security, and protection of personal information shall be governed by the Platform's Privacy Policy.

By using the Platform, users acknowledge that personal information may be collected and processed for purposes including:

Account administration
Donation processing
Grant management
Verification procedures
Fraud prevention
Security monitoring
Support services
Communication management
Platform operations
Legal compliance
Regulatory obligations
Audit requirements

Users are encouraged to review the Privacy Policy for complete information regarding data collection, privacy rights, retention practices, security measures, and data protection procedures.

SUSPENSION & TERMINATION

BRAC reserves the right, at its sole discretion, to suspend, restrict, disable, remove, investigate, terminate, or limit access to any account, campaign, petition, report, grant application, internship participation, directory submission, Lost & Found listing, content item, service, feature, or Platform activity where it reasonably believes that:

These Terms & Conditions have been violated.
Fraudulent activity is suspected.
False information has been submitted.
Misrepresentation has occurred.
Security concerns exist.
Legal or regulatory risks arise.
Community standards have been breached.
Platform integrity may be compromised.
User safety may be affected.

BRAC may remove content, restrict access, freeze fundraising activities, suspend privileges, revoke recognitions, terminate memberships, reject applications, or take other appropriate actions where necessary.

Such actions may occur with or without prior notice where permitted by applicable law.

BRAC shall not be liable for losses, damages, inconvenience, reputational impacts, delays, or consequences arising from suspension or termination actions undertaken in good faith.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, BRAC, its directors, officers, employees, volunteers, advisors, representatives, affiliates, service providers, licensors, contractors, partners, and authorized personnel shall not be liable for any direct, indirect, incidental, consequential, punitive, special, exemplary, or other damages arising from or relating to:

Use of or inability to access the Platform
Donation processing issues
Fundraising activities
Campaign-related disputes
Grant applications
Petition activities
SOS requests
Report BRAC submissions
Lost & Found services
Internship programs
Educational resources
Third-party services
Service interruptions
Technical failures
Security incidents beyond reasonable control
Data loss
Platform downtime
Reliance upon informational content
Errors, omissions, inaccuracies, delays, or interruptions

Use of the Platform is undertaken voluntarily and entirely at the user's own risk.

Nothing in these Terms shall exclude liability where such exclusion is prohibited by applicable law.

INDEMNIFICATION

Users agree to defend, indemnify, and hold harmless BRAC Global Social Foundation, its directors, officers, employees, volunteers, interns, representatives, advisors, affiliates, partners, licensors, contractors, service providers, and authorized personnel from and against any claims, liabilities, losses, damages, penalties, fines, investigations, proceedings, judgments, settlements, costs, expenses, or legal fees arising from or relating to:

Violation of these Terms & Conditions
Misuse of the Platform
Fraudulent activities
User-generated content
False representations
Intellectual property infringements
Defamatory submissions
False reports or allegations
Campaign-related misconduct
Unauthorized use of Platform services
Violations of applicable laws or regulations
Breach of third-party rights

This indemnification obligation shall survive account closure, termination of participation, suspension of services, or discontinuation of Platform access.

AMENDMENTS & POLICY UPDATES

BRAC reserves the right to revise, amend, modify, replace, supplement, update, suspend, discontinue, or otherwise alter these Terms & Conditions at any time.

Changes may be introduced to reflect:

Legal developments
Regulatory requirements
Security enhancements
Technological advancements
Operational improvements
Platform expansion
Organizational requirements
Community protection measures
User experience improvements

Updated versions shall become effective upon publication unless otherwise specified.

Users are encouraged to review these Terms periodically.

Continued use of the Platform following publication of revised Terms & Conditions constitutes acceptance of such modifications and updates.

GOVERNING LAW & JURISDICTION

These Terms & Conditions shall be governed by, interpreted, and enforced in accordance with the laws of India.

Any dispute, claim, controversy, action, proceeding, complaint, or legal matter arising out of or relating to:

Use of the Platform
Donations
Fundraising activities
Grant programs
Petition services
Report BRAC submissions
SOS services
Lost & Found services
Internship programs
Volunteer participation
Membership activities
Educational resources
Community initiatives
Any related Platform services

shall be subject to the exclusive jurisdiction of the competent courts located in Maharashtra, India, unless otherwise required by applicable law.

Nothing in this section shall limit BRAC's right to seek appropriate legal remedies in any competent jurisdiction where necessary to protect its rights, intellectual property, assets, users, systems, reputation, or lawful interests.

SEVERABILITY

If any provision, clause, section, term, or portion of these Terms & Conditions is determined by a court, tribunal, regulator, governmental authority, or competent body to be invalid, unlawful, unenforceable, or contrary to applicable law, such determination shall not affect the validity, legality, or enforceability of the remaining provisions.

The remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

Any invalid or unenforceable provision shall, where possible, be interpreted and enforced in a manner that most closely reflects the original intent of the provision while remaining compliant with applicable legal requirements.
