It is the genocide of a gender. Female Foeticide is the selective abortion of female foetuses, driven by a deep-seated cultural preference for sons. It is not just a medical crime; it is a social catastrophe.

Technology meant to save lives (Ultrasound) is being used to end them. The result is a skewed demographic that threatens the very fabric of society. A girl has the constitutional right to be born.

The Technology Trap

Portable ultrasound machines have brought sex determination to the remotest villages. Unscrupulous doctors, motivated by profit, collude with families to identify the gender of the foetus. If it's a girl, the pregnancy is terminated. This is often coded as "F" or "Pink" in medical files to evade the law.

Societal Consequences

  • Bride Shortage: In states like Haryana and Punjab, men cannot find brides, leading to the trafficking of women from other states ("Paro").
  • Dowry Link: Daughters are seen as an economic burden due to the dowry system, incentivizing their elimination before birth.
  • Violence Against Women: A society that kills girls before birth is inherently violent towards the women who survive.

Section 6

Total Ban

Prohibits the use of any technology (Ultrasound, Amniocentesis) for the purpose of sex determination. No doctor can reveal the sex of the foetus.

Doctors, owners of clinics, or family members seeking the test face imprisonment up to 3 years (5 for repeat offence) and suspension of medical license.

Form F

Every ultrasound clinic must fill 'Form F' for every pregnant woman, stating the medical reason for the scan. Incomplete forms are a crime.

Decoy Operations

Appropriate Authorities (District Magistrates) conduct sting operations using pregnant decoys to catch doctors agreeing to reveal sex.

MTP Act Linkage

Abortion is legal in India, but NOT for sex selection. The MTP Act protects the mother's health; the PCPNDT Act prevents gender discrimination.

Why Does It Continue?

Doctor-Patient Nexus

It is a crime with no victim to complain. The family wants a boy, the doctor wants money. Both collude to keep the act secret.

Portable Machines

Unregistered portable ultrasound machines are easily moved from house to house in rural areas, evading clinic raids.

Economic Fear

"Raising a daughter is like watering a neighbor's plant." The fear of dowry and lack of old-age support from daughters drives son preference.

Weak Evidence

In court, it is hard to prove that a specific abortion was due to sex selection unless the doctor is caught on camera revealing the sex.

IVF Loophole

Pre-implantation genetic diagnosis (PGD) in IVF clinics allows selecting embryos by sex before pregnancy begins, a sophisticated loophole.

Frequently Asked Questions

Is abortion illegal in India?

No. Abortion is legal up to 24 weeks under the MTP Act. However, abortion based solely on the sex of the foetus (sex selection) is illegal under the PCPNDT Act.

Can a doctor reveal sex verbally?

No. Any communication (verbal, signs, or written) about the sex of the foetus is a crime. Even saying "buy pink clothes" or "Jai Mata Di" as a code is punishable.
