GENDER JUSTICE

DIGNITY HAS NO GENDER

Justice is not a zero-sum game. It is about dismantling the patriarchy that oppresses women, and the transphobia that erases the LGBTQIA+ community.

From equal pay for equal work to the legal recognition of transgender identity, the fight is for a world where biology does not determine destiny. Equality is not just a women's issue; it is a human issue.

The Glass Ceiling & The Broken Floor

Gender injustice exists at two levels. At the top, the "Glass Ceiling" prevents women from reaching boardrooms. At the bottom, the "Broken Floor" leaves women and transgender persons in low-paying, unsafe, and informal jobs without social security.

Forms of Systemic Bias

  • Workplace Discrimination: Firing women when they get pregnant or refusing to hire trans persons due to "culture fit."
  • Sexual Harassment: Unwelcome advances, lewd comments, and the abuse of power dynamic in offices (Quid Pro Quo).
  • Unpaid Care Work: Women perform 10x more unpaid domestic labor than men, limiting their economic potential.

Landmark Judgments

NALSA vs Union of India (2014)

Navtej Singh Johar (2018)

Decriminalized Section 377. Consensual same-sex relationships are no longer a crime. Love is not illegal.

Equal Remuneration Act 1976

Mandates equal pay for men and women performing the same work or work of a similar nature.

Part 4: The Barriers

Why Does Bias Persist?

ID Card Issues

Transgender persons struggle to get "TG" ID cards due to bureaucratic apathy and insensitivity at government offices.

Lack of Facilities

Schools and offices lack gender-neutral toilets, forcing trans individuals to drop out or face daily humiliation.

The "Mommy Track"

Women returning from maternity leave are often demoted or sidelined, assuming they are no longer "committed" to work.

Housing Bias

Landlords refuse to rent to single women or trans persons, forcing them into ghettos or unsafe living conditions.

Silence on Harassment

Victims of workplace harassment fear retaliation (being fired or blacklisted) if they file a formal POSH complaint.

YOUR ROLE

Use preferred pronouns. Challenge sexist jokes. Ensure your workplace has an active Internal Committee (IC).
