HARASSMENT & TORTURE

THE INVISIBLE WOUNDS

Torture is not just physical; it is the deliberate breaking of the human spirit. From the silent corridors of Workplace Harassment to the dark cells of Custodial Torture, millions suffer daily in silence.

It leaves no fingerprints, only scars on the psyche. Whether it is mental cruelty at home or abuse of power by authorities, it is a violation of the fundamental right to dignity.

Forms of Systematic Abuse

Harassment is a chameleon crime. In the workplace, it is the abuse of power for sexual or professional favors (Quid Pro Quo). In police custody, it is third-degree torture to extract confessions. In homes, it is mental gaslighting and isolation.

The Psychology of Control

  • Workplace (POSH): "Hostile Environment" creation where victims are humiliated, isolated, or denied work to force resignation.
  • Custodial: The use of force by state agents (Police/Military) violating the "DK Basu Guidelines" of arrest.
  • Psychological: Constant degradation, threats to loved ones, and sleep deprivation to break mental resistance.

The Human Cost

PTSD & AnxietyChronic

Panic attacks, flashbacks, and inability to trust.

Career DestructionTotal Loss

Victims often quit jobs or are blacklisted.

Physical DisabilityPermanent

In custodial cases, nerve damage or fractures.

"Torture does not just hurt the body; it dismantles the personality. The victim survives, but the person they were is gone."

Part 3: The Law

Bharatiya Nyaya Sanhita (BNS) 2023

The legal shield against abuse of power and dignity.

BNS Section 85

Cruelty (Domestic/General)

"Whoever subjects a woman to cruelty... harassment with a view to coercing her or any person related to her to meet any unlawful demand."

3 Years Jail + Fine

BNS Section 115

Voluntarily Causing Hurt

"Whoever does any act with the intention of thereby causing hurt to any person..." Covers physical beating and torture.

1 Year Jail / Fine

Specialized Protections

POSH Act 2013 (Workplace)

Prevention of Sexual Harassment (POSH) mandates an Internal Complaints Committee (ICC) in every organization with 10+ employees.

SC/ST Prevention of Atrocities Act

Protects marginalized communities from harassment, humiliation, and violence. Non-bailable offence.

DK Basu Guidelines (Custodial)

Supreme Court rules for arrest: Police must wear name tags, inform family, and provide medical checkups to prevent secret torture.

Part 4: The Barriers

Why Is Silence Chosen?

Fear of Reprisal

"If you report this, you're fired." Or in custody, "If you speak, we beat you more." Fear is the silencer.

Power Imbalance

The harasser is often a boss, a police officer, or a family head. The victim feels powerless against their authority.

Lack of Proof

Psychological torture leaves no bruises. Workplace harassment often happens in private. Proving it is difficult.

Victim Shaming

"She asked for it." "Why was he in police custody anyway?" Society often blames the victim for their own abuse.

Legal Costs

Fighting a defamation suit filed by a harasser or suing the state for torture requires money most victims don't have.

YOUR ROLE

Believe the survivor. Document everything. Support them in breaking the silence.
