The Contract Trap

Modern employment often disguises itself as "Contract Labour." Companies hire workers through third-party agencies to avoid providing Provident Fund (PF), ESI (Health Insurance), and Gratuity. The worker does the same job as a permanent employee but for half the pay and zero job security.

High-Risk Zones

  • Construction: Highest rate of injury. Workers fall from heights or are buried in landslides due to lack of safety nets.
  • Manual Scavenging: Despite being banned, thousands still clean sewers by hand, dying from toxic gas inhalation.
  • Garment Industry: Women work 12-hour shifts in unventilated rooms, facing verbal abuse and denied bathroom breaks.

Why Are Rights Denied?

No Paper Trail

Without an appointment letter, a worker cannot prove they were employed, making it impossible to claim unpaid wages in court.

Union Busting

Employers fire ringleaders who try to organize unions, using fear to keep the workforce compliant.

Migration

Migrant workers are "outsiders" with no local voting power or social support, making them easy targets for exploitation.

Labor Inspection

The number of labor inspectors is woefully low. Inspections are often corrupt or announced in advance.

Gig Economy

Delivery riders are classified as "partners," not employees, stripping them of all benefits like PF and minimum wage.

Frequently Asked Questions

Is there a minimum wage in India?

Yes. Minimum wages vary by state and sector. The Code on Wages 2019 aims to set a "National Floor Wage" below which no state can go. Paying less than minimum wage amounts to forced labor.

Can my employer fire me without notice?

Generally, no. Under the Industrial Disputes Act (and new codes), employers must provide notice (usually 1 month) or pay in lieu of notice for permanent employees. Contract labor rules are weaker but still offer some protection.

What is E-Shram?

It is a national database for unorganized workers (construction, domestic, agriculture). Registering gets you a Unique ID (UAN) and access to insurance and future social security benefits.

Is my donation tax deductible?
