The Myth of "Stranger Danger"

Movies teach us to fear the stranger in the dark alley. Reality is far more terrifying. In 96% of cases, the rapist is a neighbor, a relative, a teacher, or an employer. The betrayal is not just of the body, but of trust.

Forms of Sexual Violence

  • Aggravated Rape: Committed by police, armed forces, public servants, or gang rape. Carries harsher punishment.
  • Deceitful Means (BNS 69): Sexual intercourse under false promise of marriage or identity concealment ("Love Jihad" context).
  • Child Abuse (POCSO): Sexual assault on anyone under 18. Consent is irrelevant in these cases.

Rights of the Survivor

Zero FIR

A survivor can file a complaint at ANY police station. Police cannot refuse based on jurisdiction.

Two-Finger Test Banned

The Supreme Court has banned the "Two-Finger Test" for virginity. Performing it is now a punishable offence for doctors.

In-Camera Trial

Rape trials must be conducted in private (in-camera) to protect the identity and dignity of the survivor.

Part 4: The Barriers

Why Does Justice Fail?

Victim Shaming

Society asks "What was she wearing?" or "Why was she out late?" shifting the blame from the rapist to the survivor.

Forced Compromise

Elders or police often pressure the victim to "settle" or marry the rapist to save "family honor." This is illegal but common.

Trial Delays

Cases drag on for 5-10 years. Survivors are exhausted by repeated court visits and hostile cross-examination.

Botched Evidence

Delay in medical examination leads to loss of DNA evidence. Many police stations lack Rape Investigation Kits.

Witness Threats

Accused out on bail often threaten the survivor or witnesses, forcing them to turn hostile in court.

Frequently Asked Questions

Is there a time limit to report rape?

No. There is no limitation period for reporting rape in India. You can report it even years later, though medical evidence is strongest within 72 hours.

What if the police refuse to file an FIR?

Refusing to file a rape FIR is a crime under Section 199 (BNS). You can file a "Zero FIR" anywhere or complain to the SP/Magistrate.

Does the survivor have to pay for medical tests?

No. All medical examinations and first aid for rape survivors are free of cost at all government and private hospitals under the law.

Is my donation tax deductible?
