Sexual Harassment is not limited to physical assault. It includes Verbal Abuse (lewd comments, jokes), Non-Verbal Abuse (staring, displaying porn), and Digital Harassment (sending unsolicited explicit messages).

Complaints should usually be filed within 3 months, but the ICC can extend this if the victim was unable to report earlier.

Frequently Asked Questions

Can I report harassment after resigning?

Yes. Under the POSH Act, you can file a complaint with the ICC or LCC within 3 months of the incident (extendable), even if you have left the company.

Is a WhatsApp message harassment?

Yes. Any unwelcome sexual advance, including messages, videos, or emojis sent digitally, counts as sexual harassment under both BNS and POSH Act.

Can men be victims?

While the POSH Act primarily protects women, many companies have gender-neutral policies. Under BNS 2023, certain sections are gender-neutral, but specific sexual harassment laws largely focus on women.
